These Website Terms of Service ("Terms") govern your access to and use of BookedSolidInspector.com and any subdomains (collectively, the "Site"), including the AI agents Parker and Josh and any interactive feature made available through the Site. The Site is operated by Outcrop Holdings, Inc. ("Outcrop," "Company," "we," "us," or "our"), a Florida corporation.
How you accept these Terms. Before you start a voice call or text chat with Parker or Josh, submit a form, or request a demonstration, you will be asked to confirm that you accept these Terms and our Privacy Policy. By confirming, you agree to be bound by both. Continued browsing of the Site also indicates your acknowledgment of these Terms, but the obligations in Sections 6, 8, 9, and 13 apply to you only where you have affirmatively accepted them as described above.
If you do not agree, please do not use the interactive features of the Site.
These Terms apply to all visitors, including prospective subscribers, licensed home inspectors evaluating the Booked Solid Inspector service, and any other individual accessing the Site. They do not govern the commercial relationship between Outcrop and its subscribers, which is addressed in the Booked Solid Inspector Customer Agreement.
The Site is intended for adults who are, or represent, licensed home inspection businesses considering or currently using the Booked Solid Inspector service. By using the Site you represent that:
If you are accessing the Site on behalf of a business, you represent that you have authority to bind that business to these Terms.
The Site makes available two AI-powered agents:
Parker — Booked Solid AI Product Specialist. Parker answers questions about the Booked Solid Inspector service: how it works, what it costs, what the engines do, and how to get started. Parker is available by voice call, Spanish-language voice call ("Habla con Parker"), and text chat.
Josh — AI Inspection Scheduling Specialist. Josh is a live demonstration of the Booked Solid Inspector booking agent. Josh answers questions and can book an appointment into a demonstration account maintained by Outcrop, so that prospective subscribers can experience the booking flow firsthand. Josh is available by voice call, Spanish-language voice call ("Habla con Josh"), and text chat.
Both agents conduct conversations in English and Spanish.
Parker and Josh are artificial intelligence systems. All interactions with them are automated. Neither Parker nor Josh is a human, a licensed professional, a lawyer, a financial advisor, or an employee of Outcrop. By engaging with either agent you acknowledge:
Voice calls with Parker and Josh are recorded and transcribed. You will be notified of recording at the start of every call. By remaining on the call after that notice, you consent to being recorded. Text chats are logged.
Recordings, transcripts, and chat logs are handled in accordance with our Privacy Policy. We review individual conversations to check accuracy and improve how our agents perform. We do not use them to train artificial intelligence models.
Parker and Josh conduct conversations in Spanish when accessed through the "Habla con Parker" or "Habla con Josh" options. These Terms apply equally to Spanish-language interactions. The same limitations regarding AI-generated responses, recording, and demonstration-only bookings apply regardless of the language in which the conversation is conducted.
Parker and Josh are not equipped to handle emergencies. Do not use these agents to request emergency assistance. If you have an emergency, contact your local emergency services — 911 in the United States — immediately.
The booking feature available through Josh on this Site is a live demonstration of the Booked Solid Inspector booking workflow. Bookings made through Josh on this Site are entered into a demonstration account maintained by Outcrop for prospective subscriber evaluation, currently operated under the name "Acme Home Inspections." Specifically:
Outcrop reviews demonstration bookings to check Josh's booking accuracy and conversation quality. By completing a demonstration booking, you consent to that review.
The Site and all content on it — including text, graphics, logos, page designs, marketing copy, the agent names "Parker" and "Josh," conversation flows, audio generated by our agents, and the underlying software — is the property of Outcrop Holdings, Inc. or its licensors and is protected by United States copyright and other applicable law.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purpose: evaluating and using the Booked Solid Inspector service. This license does not include the right to:
"Booked Solid Inspector," the Booked Solid Inspector logo, the agent names "Parker" and "Josh," and the phrase "The Ultimate Business Building System" are names and branding used by Outcrop Holdings, Inc. in connection with the Service. Unauthorized use is prohibited.
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:
Outcrop reserves the right to suspend or terminate access to the Site for any user who violates these Terms or whose use we reasonably believe poses a risk to the Site, other users, or third parties.
THE SITE, INCLUDING PARKER AND JOSH, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUTCROP EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
AI-generated responses from Parker and Josh are produced automatically and may contain errors, omissions, or outdated information. You should independently verify any material information before relying on it.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUTCROP HOLDINGS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO:
IN NO EVENT SHALL OUTCROP'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).
This Section does not apply to the commercial relationship between Outcrop and a subscriber, which is governed by the limitation of liability in the Booked Solid Inspector Customer Agreement.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Outcrop Holdings, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way connected with:
The Site may contain links to third-party websites or reference third-party services. Outcrop does not control and is not responsible for the content, privacy practices, or availability of any third-party site or service. A link does not constitute an endorsement.
Parker and Josh are powered in part by third-party infrastructure, including telecommunications, speech recognition, and artificial intelligence providers. Your interactions may be processed by those providers subject to their own terms and privacy policies. The categories of provider we use are described in our Privacy Policy, and a current list identifying them by name is available on request.
Your use of the Site is also governed by our Privacy Policy, available at BookedSolidInspector.com/privacy. The Privacy Policy describes how we collect, use, and share information — including call recordings, transcripts, chat logs, and information you provide during demonstration bookings. By using the interactive features of the Site, you consent to the practices described there.
Before initiating any formal proceeding, you agree to contact Outcrop at the address in Section 16 and give us thirty (30) days to attempt to resolve the dispute informally. Most concerns can be resolved this way.
If informal resolution fails, any dispute arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules — or, where the AAA determines that its Consumer Arbitration Rules apply to you, under those rules — seated in Lake County, Florida. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND OUTCROP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Either party may bring an individual claim in small claims court instead of arbitration, provided the claim qualifies under applicable small claims rules and remains in small claims court.
Either party may seek injunctive relief in court to protect its intellectual property or confidential information.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. You consent to the personal jurisdiction of the state and federal courts located in Florida for any matter not subject to arbitration.
The Site. Outcrop may modify, suspend, or discontinue the Site or any feature — including either AI agent — at any time. Because the Site is provided free of charge, we do so without liability to you.
These Terms. We may update these Terms by posting a revised version bearing a new version number and updated effective date. We will post a prominent notice on the Site at least thirty (30) days before a material change takes effect, and where we hold your email address in connection with an inquiry, we will notify you by email. Changes required by law or necessary to address a security risk may take effect immediately, with notice given as promptly as practicable.
Your continued use of the Site after the effective date of an update constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, your remedy is to stop using the Site. Prior versions are available on request.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Outcrop with respect to your use of the Site as a visitor. They supersede all prior agreements and understandings relating to that subject matter. They do not modify the Booked Solid Inspector Customer Agreement.
Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent possible and the remaining provisions will remain in full force.
No waiver. Outcrop's failure to enforce any provision on any occasion is not a waiver of its right to enforce that provision in the future.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Outcrop may freely assign these Terms.
Language. These Terms are written in English. If translated, the English version controls in the event of any conflict.
If you are a Booked Solid Inspector subscriber and a conflict arises between these Terms and the Booked Solid Inspector Customer Agreement, the Customer Agreement controls as to the subject matter it covers.
